RULE CHANGES BACKGROUND

At the meeting of the Board meeting held 17 February and subsequent approvals arising from the recent Nomination process for Elections the following changes to the Rules of MTAQ are tabled for consideration by Members.

The process for any Alteration to the Associations Rules is outlined at 22.1 in our current Rules, to view CLICK HERE.

The first change relates to updating Chairman position to Chair positions throughout the Rules.

The Secretary position for Divisions will be removed. This position is not required for Divisional Committees as they do not have the same requirements and reporting of the MTAQ Board. MTA Queensland will provide full secretariat support for meeting notices, agendas minutes etc. A Transitional Rule will be inserted so current positions remain to expiry of their term.

BACKGROUND: All Elections were paused due to COVID 19 causing an anomaly in our Rules as the Schedule of Elections due did not align with the dates/years the Elections were held.

Insert a Rule as a general provision:

Any event outside of the control of the Association that impacts our capacity to hold Elections aligned with Schedule 1 and 2 of the Rules shall cause the Schedule to commence where it was paused without a requirement to change the Schedule within the Rules to accommodate. This includes but is not limited to the affects of a Pandemic or other event. Changes to the Schedules for this reason shall be altered under Rule 22.1(c) Following an alteration to the Rules as aforesaid, if any notice as submitted to the relevant industrial registry by MTA Queensland requires amendment at the direction of the relevant industrial registry so as to ensure compliance with the provisions of the relevant industrial legislation, the MTA Queensland Board shall be authorised to amend or vary the Rule at the direction of the industrial registrar provided that there is no substantial departure from the scope or intent of the original resolution.

Clarify the opening and closing time for all Elections to our own time zone of AEST to avoid confusion for nominations, ballots and other election requirements.

RECOMMENDATION:

The Members resolve to consider the changes and if approved authorise for the changes to be drafted and submitted for application to the Fair Work Commission.
